  1. This website (the “Website”) is operated by the Environment Agency and in these terms and conditions (the “Website Terms and Conditions”) "we, our, us", refers to the Environment Agency.  The Website Terms and Conditions constitute an agreement with the user of this site (“You”) and the Environment Agency a Non-Departmental Public Body whose principal office is at Rio House, Waterside Drive, Aztec West, Almondsbury, Bristol BS32 4UD.
  2. By accessing the content of this Website You agree to be bound by the Website Terms and Conditions set out here and You accept our privacy policy (click here to view our privacy policy). If You object to any of the terms and conditions You should leave the Website immediately.
  3. The Website Terms and Conditions apply to the whole of the Website including pages You access before and after registration. Customers wishing to use the online ordering service will need to register and sign in.
  4. The Website Terms and Conditions are subject to change at any time, and it is your responsibility to check them regularly in case there are any changes. Continuing to use the site after a change has been made will signify your acceptance of the changes.
  5. All intellectual property rights in the Website, including those in respect of information You view or order through the Website ("Information") are owned wholly by the Environment Agency and Ordnance Survey from whom we are licensed to use mapping data. To the best of our knowledge and belief we have all appropriate third party permissions.
  6. The Website provides access to a catalogue of material which is available to be licensed by You. Any use of Information is strictly limited to the terms of a specific data licence relating to You and the specific Information (the “Data Licence”) and which will be confirmed to You in a confirmation e-mail on completion of your order.
  7. Aside from Information, which will be subject to the terms of the Data Licence, nothing from the Website may be copied, reproduced, republished, downloaded, uploaded, linked to, stored in any medium (including in any other website), distributed in any way, posted, shown, transmitted or re-transmitted in any way without first obtaining written permission from us.
  8. You agree to use this site only for lawful purposes and in a manner which does not infringe the rights of, or restrict or inhibit the use and enjoyment of this site by any third party.
  9. You must not use the Website in a way that could impair the performance, corrupt the content, compromise the security or otherwise reduce the overall functionality of the Website.
  10. You shall indemnify the Environment Agency against any losses, expenses costs or damages incurred by it as a result of your breach of the Website Terms and Conditions or your unauthorised use of the Website.
  11. We cannot guarantee uninterrupted availability of the Website.
  12. We cannot guarantee that the Website is up to date or free of any errors or defects and You should check it for viruses and other items that may affect your computer.
  13. We will under no circumstance be liable for indirect, special, or consequential damages including any loss of business, revenue, profits, goodwill, reputation anticipated savings or data in relation to your use of the Website. Nothing within this Agreement will operate to exclude any liability for death or personal injury arising as result of the negligence of the Environment Agency or any of their employees or agents. Any implied promise or warranty from us is excluded as far as the law allows.In these terms and conditions "we, our, us", refers to the Environment Agency.
  14. If any part of this Agreement is found by a court of competent jurisdiction or other competent authority to be unenforceable, then that part will be severed from the remainder of the Agreement which will continue to be valid and enforceable to the fullest extent permitted by law.
  15. No third parties shall have rights to enforce any part of this agreement under the Contracts (Rights of Third Parties) Act 1999.
  16. This agreement shall be governed and construed in accordance with English law.

If you purchase data from our website, we will ask you to accept a data licence which comprises our terms of sale in full, before you place your order.  A summary of our Delivery, Refund and Returns policy is shown below:

Delivery policy

If your order is below 1GB in size (before it has been zipped), you will be given the option of choosing delivery by download or requesting delivery on DVD. If your order exceeds 1GB in size (before it has been zipped), we will automatically dispatch the order on DVD.

Your order will be available to download as soon as payment has been received and for 28 days thereafter, after which it will be removed from our systems.

Refunds and Returns policy

In accordance with the Consumer Protection (Distance Selling) Regulations, post-contractual cancellation and refund will not be available to business customers.

Sales to non-commercial customers:
If you opt to receive your order by CD/DVD, provided the CD/DVD is not damaged and the security seal on the CD/DVD is not opened or tampered with you can cancel the contract within seven days of you receiving the CD/DVD and we will refund the charges that you have paid for it. The seven day period starts on the day after you receive the CD/DVD. To cancel the contract you must write to us by email at ARCHIVED-LIDARDATA@environment-agency.gov.uk and you must pay the cost of returning the CD/DVD to us. We will issue the refund as soon as possible after the DVD has been received by us and in any event within 30 days of the refund being approved.

If you opt to receive your order by download or email attachment, and by your acceptance of the terms and conditions of sale you agree to the service commencing, your right to cancel the contract ends as soon as we start to collate your order for you.
